Learned APP, Mr.Pandya, waives service of rule on behalf of respondent-State.

By way of this application, the applicant-convict has prayed that he be enlarged on temporary bail since he wants to perform after death rituals of his brother who has died on 25th February, 2011.

Considering the totality of the facts, discretion does not deserve to be exercised.

Hence, application is rejected. Rule discharged.
