Heard learned counsel for the petitioner, Shri Sujit Kumar Rai, learned counsel for the respondents no. 2 to 9 and learned Standing Counsel appearing for the State-respondent no. 1.
The petitioner is a Cadre Secretary. By the order impugned dated 28.9.2017 he has been transferred from one society to another. The petitioner is resisting the aforesaid transfer on the ground that only six months remain to his retirement and, therefore, he should not be transferred.
There is no provision under the Act or the bye laws or any guideline that such transfer cannot be made if only few months remain from retirement. As such, I am not inclined to interfere in the same.
However, it is always open for the petitioner to make a representation to the District Administrative Committee-respondent no. 9 which may consider the claim of the petitioner in accordance with law.
With the aforesaid direction, the writ petition is disposed of.
