In this Appeal, one of the basic contentions as raised and to be decided is about the type of vehicle for which the Driving License was issued in the context of findings of the Tribunal that the deceased had a Driving License for Light Motor Vehicle and was not competent to drive the heavy vehicles.
Form No.4 issued under Rule 14 to the Motor Vehicle Rules provided for application to be made for obtaining driving license and the said form describes the type of vehicle for which the license is to be applied. Certain clauses came to be deleted and introduced in March 2001 (introducing transport vehicle and deleting light motor vehicles). Therefore, reliance is placed on the decision rendered in the case of National Insurance Company Limited v. Annappa Irappa Nesaria Alias Nesaragi and Others reported in 2008 3 SCC 464.
The matter be listed on 10th July, 2012.
