JUDGMENT / ORDER

(Per : HONOURABLE THE ACTING CHIEF JUSTICE MR.BHASKAR BHATTACHARYA) After hearing the learned counsel for the parties and after taking into consideration the various affidavits filed by the parties, we find that even in the affidavit filed on behalf of the respondent No.4, Taluka Development Officer, it has been clearly stated that illegal resolution has been passed by the Gram Panchayat and construction of buildings on the land in question have been made in utter violation of the laws.
It appears that in the past, on September 6, 2011, a Division Bench of this Court passed directions that the parties would not make any further construction nor would they alienate any building or land in question. Our attention has been drawn to the fact that in spite of the injunction order, constructions of buildings are being continued.
In such circumstances, we direct the District Development Officer, the respondent No.3, to see that no further construction of any building or any alienation of land or building takes place in the area in question.
The District Development Officer is also directed to take immediate action under the Code of Criminal Procedure against the person/s responsible for such illegal acts and report compliance to this Court by January 19, 2012.
Let the matters appears on January 19, 2012.
