The prayer made in the instant petition is for issuing direction to the trial Court to decide the application for temporary injunction bearing paper No. 6C in Original Suit No. 259/2017, within a time specified by this Court.
The suit has been filed by the petitioner and wherein, an application for temporary injunction was also filed. It is stated to be pending. A perusal of the order sheet reveals that service on the defendants was held to be sufficient by publication.
Having regard to these facts, the instant petition is disposed of by directing the trial Court to decide the application for temporary injunction expeditiously, by fixing short dates, without granting unnecessary adjournments.
At this stage, counsel for the petitioner submitted that the Court may direct the defendants to maintain status quo till the application for temporary injunction is decided.
The trial Court has refused to grant ex-parte ad interim injunction and the said order is not under challenge and, therefore, this Court is not inclined to grant any ex-parte injunction without hearing the other side.
The prayer made in this regard is therefore rejected.
