K.Chokalingam vs The District Collector

Madras High Court|08 September, 2017

JUDGMENT / ORDER

[Order of the Court was made by G.R.SWAMINATHAN, J.] The petitioner herein is a resident of Uvarkulam Village. A dispute arose with regard to the printing of his name on the vibhuthi packets in connection with the celebration of the Kumbabeshakam of Arulmigu Sri Muthumariamman Temple. The 7th respondent herein therefore filed W.P.(MD)No.15161 of 2017 before this Court.
2.This Court heard both the parties and directed the authorities to grant permission as well as police protection for conducting kumbabishegam on 03.09.2017. The writ petitioner herein was allowed to distribute the without printing his name. The Kumbabeshakam appears to have been celebrated on the said date. However, the writ petitioner alleged that the 'vari' was not collected from the eligible persons and that the performance was not as per the agama sasthras. He therefore seeks a direction for re -conducting the Kumbabishegam festival by following agamas.
3.We are afraid that such a prayer cannot be granted by this Court. The Kumbabishegam of the temple has already been celebrated. There is no question of giving a direction for re-conducting the said festival. If the writ petitioner is having any grievance with regard to the temple management, it is always open to him to work out his remedies in the manner known to law before the appropriate forum. Invocation of Jurisdiction under Article 226 of the Constitution of India is clearly not available in such cases.
4.However, we make it clear that we have not determined the rights of the contesting parties. All that we directed by our order dated 28.08.2017 in W.P.(MD)No.15161 of 2017 was to work out an arrangement with regard to conduct the Kumbabishegam on 03.09.2017. With this Observation, this writ petition stands dismissed. No Costs.
