Heard learned advocates for the parties. In view of the averments made in the application, the delay caused in filing the first appeal is required to be condoned. Accordingly, delay is condoned. Civil application No. 13197 of 2011 stands allowed accordingly. First appeal may come up for hearing as to admission on 24th April 2012. Rule is made absolute accordingly.

Civil Application No. 2573 of 2012 shall not survive as respondent no. 5 has already been served by way of affixing and hence is disposed of accordingly.
