Katiyo vs State

High Court Of Gujarat|16 March, 2012

JUDGMENT / ORDER

(Per : HONOURABLE MR.JUSTICE PARESH UPADHYAY) By way of this application, the applicant-convict has prayed that he be enlarged on regular bail pending the appeal or the appeal may be taken up for hearing at an early date.
So far suspension of sentence pending the appeal is concerned, from record, it transpires that this is a successive bail application since once the regular bail was already rejected by this Court vide order dated 20th July, 2010 as recorded in Criminal Misc. Application No.7845 of 2010.
Thus, this being the successive bail application is not entertained and the same is rejected.
So far the early hearing of the main appeal is concerned, we find that this appeal is of the year 2010, we do not find any reason to take up the hearing out of turn. However, Registry is directed to expedite the preparation of the paper book.
The application is disposed of accordingly.
