(Per : HONOURABLE MR.JUSTICE V. M. SAHAI) This is an application for condonation of delay of 12 days in filing for restoring the Misc. Civil Application No.2100 of 2011.
We have heard learned advocate Mr.Nandlal Thakkar for the applicant and learned advocate Mr.Adil Mirza for the respondent.
Considering the contents of the application, it cannot be said that the delay caused in filing Misc. Civil Application No.2100 of 2011 has remained totally unexplained. Therefore, we are of the view that the delay deserves to be condoned. Accordingly this application is allowed. Delay is condoned. Rule is made absolute.
