THIS WRIT PETITION COMING ON FOR PRELIMINARY HEARING THIS DAY, THE COURT MADE THE FOLLOWING:
ORDER R. DEVDAS J., (ORAL):
The parties have filed a joint memo dated 14.02.2019, and the respondent is also present before this Court.
2. In terms of the joint memo, the petitioner- Corporation has agreed to reinstate the respondent- workman to his original post by withholding five annual increments with cumulative effect, without back wages and without consequential benefits, from the date of dismissal till the date on which the respondent reports to duty in terms of joint memo. It is also agreed that the continuity of service for the dismissal period is to be considered for the purpose of terminal benefits.
3. In terms of the joint memo, the writ petition is disposed of modifying the impugned award dated 12.01.2018, passed by the III Additional Labour Court, Bengaluru, in REF.No.21/2016.
4. Ordered accordingly.
