Petitioner claims that the partition suit between the parties was decided and the parties came into possession over their respective parts of the land as decreed in the final judgment of the court below. The private respondents are now trying to disturb the possession of the petitioner.
Sri Bhupendra Pal Singh, learned counsel for the petitioner does not dispute the submission of learned Standing Counsel that the petitioner has an alternative and efficacious remedy of approaching the competent court for seeking appropriate relief.
Learned counsel for the petitioner does not press the relief sought for in the writ petition. He recasts his relief and prays that he may be granted liberty to approach the competent court for redressal of his grievance.
It is always open to the petitioner to avail the appropriate remedy available to him in law.
The writ petition is disposed of.
