Heard learned counsel for the petitioners, learned A.G.A. for the respondent Nos. 1 to 3 and perused the record.
The instant petition seeks quashing of the impugned F.I.R. dated 4.10.2019 registered as Case Crime No. 533 of 2019 under Section 406 I.P.C., Police Station- Noida Sector 58, District- Gautam Buddh Nagar.
The learned counsel for the petitioners submits that the petitioners are ready to make payment of the amount of the cheque which has expired, and that a date, after a month, may be fixed so that on that date, the petitioner tenders the cheque/draft to the respondent No. 4 (informant).
In view of the above, let notice be issued to the respondent No. 4 fixing 6.1.2020.
List this case on 6.1.2020, as fresh, on which date the petitioners shall fulfil their above commitment.
Till the next date of listing, the petitioners shall not be arrested in the above mentioned case.
It is made clear that the interim order has been passed on the undertaking that on the next date, the petitioner would submit a cheque/draft of the amount concerned.
