JUDGMENT / ORDER

Two criminal original petitions, one by A4 to A6 and A8 to A10 in Crl.O.P.(MD) No.8268 of 2010 and another by A7 in Crl.O.P.(MD) No.14276 of 2010 have been filed, under Section 482 of Cr.P.C., praying to call for records in C.C.No.169 of 2009 on the file of the District Munsif cum Judicial Magistrate, Bodinayakkanur, Theni District and quash the same.
2.It is submitted by both sides that trial has begun and four witnesses have already been examined.
3.In the said circumstances, the learned counsel for the petitioners submits that the petitioners may be permitted to advance all their defence including the grounds taken in these criminal original petitions before the trial Court.
4.Considering the fact that the trial has already begun and witnesses have been examined, these criminal original petitions are dismissed. However, the petitioners are at liberty to advance all the defences including the grounds taken in these criminal original petitions before the trial Court. Consequently, connected miscellaneous petitions are also dismissed.
