JUDGMENT / ORDER

(Per : HONOURABLE MR.JUSTICE RAVI R.TRIPATHI) The present application is filed by the applicant through his sister praying for temporary bail for 90 days for treatment of his parents. It is mentioned in the application that the convict's parents are residing all alone. They are very serious. Mother of the applicant is having cataract and other ailments in eye and if timely surgery is not undertaken she may lose vision. Besides, it is mentioned that she is having problem of arthritis. She is having difficulty in sitting and doing her daily routine. It is mentioned in the application that his father is suffering from piles and also other ailments. In support of the application medical case paper from Nutan General Hospital, Visnagar is annexed which is on record with regard to the mother of the convict-Hiraben Amritbhai Patel and case papers from Ami Hospital with regard to his father are also annexed. Blood report of his father is also enclosed with the application.
2. Taking into consideration the fact that the convict is undergoing life imprisonment and he has so far undergone 1 year, 2 months and 19 days in Jail and taking into consideration the nature of the ailments averred in the application the Court finds no ground to grant temporary bail. Hence the application is rejected.
