(Per : HONOURABLE MR.JUSTICE AKIL KURESHI) This application is filed by the original claimant requesting for appropriate order of disbursement and investment of the entire amount deposited by opponent No. 3-insurance company. It appears that we had, by our order dated 02.05.2012, directed the insurance company to deposit 50% of its share of the compensation and also provided for disbursement/investment of such amount upon deposit being made eventually. However, before this order was passed, the insurance company had deposited the entire amount with cost and interest but in two installments. Rs. 66,82,552/-, was deposited on 03.04.2012, out of which, the Claims Tribunal has disbursed 30% in favour of the claimant and invested rest of the amount in fixed deposit. A further sum of Rs. 45,73,215/- has also been deposited on 01.05.2012.
In view of this development being brought to our notice, in partial modification of our order dated 02.05.2012, we provide that such amount of Rs. 45,73,215/- shall remain invested in fixed deposit in any nationalized bank till final disposal of the appeal. It is directed that no interest accruing thereon shall be released in favour of the claimant and instead such interest shall be reinvested in fixed deposits. With respect to the amount of Rs. 66,82,552/-, we do not disturb the steps already taken by the Claims Tribunal. Civil Application stands disposed of accordingly.
