1. The present application has been filed for restoration of the main matter [First Appeal (Stamp) No.3166/2011] which has been dismissed for non-prosecution by the Court [Coram: Anant S. Dave,J.] vide order dated 10.10.2011.
2. Learned advocate Mr.Devang Vyas for the applicants states that the office objections namely with regard to the Court fees and certified copy will be removed within a week.
3. Under the facts and circumstances of the case and considering the reasons mentioned in the application, the application stands allowed. The prayer made in paragraph No.5(a) is granted. The order passed by this Court on 10.10.2011 by which the matter is dismissed for non-prosecution, First Appeal (Stamp) No.3166/2011 is ordered to be restored to file on such undertaking of the learned advocate to remove all office objections within a week.
