Mr.Mengdey, learned Addl.Public Prosecutor waives service of notice of rule on behalf of respondent-State of Gujarat.

After the application is argued at length, learned advocate appearing on behalf of the petitioner seeks permission to withdraw the present application. Permission is accordingly granted. Hence the application is dismissed as withdrawn. Rule is discharged.
