The petitioner, who was working as Sweeper with the State Bank of India, retired on 31 July 2016, after attaining the age of superannuation. The relief sought in the instant writ petition is for issuance of a mandamus commanding the respondents to pay the pension and gratuity to him along with 18% interest till the date of actual payment.
Learned counsel appearing for the respondent bank has placed on record an order passed by the Chief Manager of the State Bank of India, whereby, the petitioner has been informed that the competent authority has sanctioned a sum of Rs. 4,74,878/- as gratuity and it shall be open to the petitioner to receive payment of the said amount after executing a receipt.
Counsel for the petitioner submitted that the amount calculated as gratuity is incorrect. He further submitted that the other retiral benefits including the pension are not being paid.
After considering the submissions made by learned counsel for the parties, the instant writ petition is disposed of with liberty to the petitioner to approach the respondent bank with a fresh representation along with certified copy of this order ventilating all the grievances. In that event, the same shall be decided by the second respondent, who is stated to be competent to take decision in the matter, within a period of next three months.
