Following orders were passed in the matter on 16.9.2019:-
"Grievance is that though petitioner has been promoted vide order dated 25th June2019, but he has not been released from his present place of posting and consequently petitioner is not able to join pursuant to the order of promotion.
Learned Standing Counsel may obtain instructions in the matter. Post as fresh on 26th September 2019."
Learned Standing Counsel has obtained instructions from the District Development Officer, according to which petitioner has already been relieved.
In that view of the matter, no grievance survives. Writ petition, accordingly, is dismissed.
However, it goes without saying that petitioner would be entitled to all promotional benefits pursuant to the order of promotion.
