Supplementary affidavit filed today is taken on record. Heard learned counsel for the parties.
The prayer made in the present writ petition is to issue a direction to the respondent no. 1 namely the Deputy Director of Consolidation to decide pending revision within stipulated period. It is contended in paragraph '9' of the writ petition that the petitioner has taken steps to serve the contesting respondents in view of the order passed by the Deputy Director of Consolidation. It is contended that the interim application filed by the petitioner in the revision is pending consideration.
In view of the submission of the learned counsel for the petitioner, without entering into the merits of the claim made by the parties, the present writ petition is being disposed of with the direction to the Deputy Director of Consolidation, Azamgarh to consider the interim application, if any, filed by the petitioner is pending and further to proceed with the revision in an expeditious manner.
It is made clear that the direction issued by this Court would not be treated as a tool to proceed ex-parte against the unserved opposite parties/respondents.
