Heard learned counsel for the applicant and Sri Rajeev Trivedi, learned Standing Counsel appearing for the opposite party.
From the affidavit of compliance filed on behalf of the opposite party, the Court notes that the claim of the applicant has been attended to and disposed of by an order dated 19 May 2018. The District Magistrate while dealing with the claim has found and recorded that the entire service record was kept in a locked Almirah by the applicant himself which had to be ultimately forcibly opened in the presence of the concerned SDM. The entire proceedings were also video-graphed. When this Almirah was opened it was found that no record existed. It is only thereafter that the applicant himself submitted the relevant extracts of the service record. Upon receipt thereof, the District Magistrate has taken the stand and come to conclude that the service record was deliberately retained by the applicant himself and therefore no wrong doing can possibly be fastened upon the opposite party.
From the recitals, as they appear in the order dated 19 May 2018, it is more than evident that the applicant has grossly abused the process of Court.
Accordingly, while this petition is dismissed, the Court hereby provides for the imposition of costs of Rs.10,000/- which shall be recovered from the salary of the applicant himself and failing the same as arrears of land revenue by the District Magistrate concerned within a period of one month from today.
