Kamaliya vs State

High Court Of Gujarat|12 March, 2012

JUDGMENT / ORDER

1. Three persons have preferred common petition though factual details pertaining to their appointment, in respect of which the petition has been preferred, are materially and substantially different. Therefore, in the first instance a common petition for three different petitioners having different set of facts would not be maintainable. Besides this, on the basis of the details and averments made in the petition, at this stage the relief prayed for in present petition would not be maintainable or cannot be granted. Therefore, learned advocate for the petitioners has requested for permission to withdraw present petition with a view to filing three separate petitions for all three petitioners, after mentioning all relevant factual backdrop to support the relief prayed for.
2. The request to withdraw the petition is granted. The petition stands disposed of as withdrawn with a liberty to file fresh petition, if so advised, in respect of the same subject.
