JUDGMENT / ORDER

1. Rule.
Mr.Jinesh Kapadia, learned advocate waives service of notice of Rule on behalf of the contesting respondents.
2. The present application under Section 5 of the Limitation Act has been preferred by the applicants herein - original defendants to condone the delay of 1 day in preferring the second appeal challenging the judgement and order passed by learned 4th Additional District Judge, Veraval, Camp-Una in Regular Civil Appeal No.197 of 1999.
3. Heard Mr.Vishal Mehta, learned advocate appearing on behalf of the applicants and Mr.Jinesh Kapadia, learned advocate appearing on behalf of the contesting respondents and as the application is not seriously opposed by learned advocate appearing on behalf of the contesting respondents, the present application is allowed and delay caused in preferring the second appeal is hereby condoned. Rule is made absolute accordingly. No costs.
