Rule.
Mr.Nanavati, learned APP appears and waives service of rule for respondent - State.
The instant application is filed in connection with Khokhara police station, C.R.No.-I-32 of 2011 seeking temporary bail for 30 days on the ground of sickness and operation of wife of the applicant - accused, which is scheduled on 7.7.2012.
Having considered the submissions advanced by both the sides, so also considering the medical papers annexed, stating that the surgery of the wife is scheduled on 7.7.2012, this Court is of the opinion that the application deserves to be granted in part.
The application is partly allowed and the applicant - accused is ordered to be released on temporary bail for a period of 10 days from the date of his actual release on his executing personal bond of Rs.10,000/- (Rupees Ten Thousand only) with one surety of the like amount to the satisfaction of the jail authority on the condition that the upon expiry of the temporary bail, the applicant shall immediately surrender to the concerned jail authority.
Rule is made absolute to the aforesaid extent. D.S.P.
