Following orders were passed by us on 26.11.2021, after noticing the petitioners' contention that though ceiling proceedings have lapsed in respect of the land in question, yet the names of petitioners have not been restored:-
"The grievance is that though petitioners' land has been exempted under the Urban Land (Ceiling and Regulation) Act, 1976 yet their names are not being mutated despite orders passed therein.
Learned Standing Counsel may obtain instructions from respondent nos. 2 and 3 by the next date fixed.
Post the matter as fresh on 13th December, 2021."
Sri Shubhranshu Shekhar, learned Additional Chief Standing Counsel has obtained instructions, according to which orders have already been passed by the competent authority for restoring the name of earlier tenure holders in the revenue records. Copy of the instructions have also been furnished to the counsel for the petitioners.
The concerned revenue authorities shall ensure that the order passed by the ceiling authority on 28.12.1999 shall be acted upon and duly given effect to in the revenue records, within a period of four weeks from the date of presentation of a certified copy of this order.
With the above observations/directions, this writ petition stands disposed off.
