Re: Criminal Misc. IIIrd Bail Application No.307701 of 2017 Sri Pramod Kumar Srivastava, learned counsel for the appellant and Sri I.P. Srivastava, learned AGA for the State is present.
This is the third bail application filed on behalf of the appellant. The first and second bail application were rejected on 13.11.2013 and 12.2.2015 vide Criminal Misc. Bail Application No. 98941 of 2013 and Criminal Appeal No.1447 of 2013 respectively.
It has been submitted by learned counsel for the appellant that the appellant is languishing in jail since 13.2.2013. It has been further submitted that the co- accused Makhan Pasi has already been enlarged on bail by the same order by which the bail of the appellant was rejected though the case of the appellant is parallel to that of the co-accused Makhan Pasi.
Learned A.G.A. opposed the prayer for bail and submitted that that the recovery of the dead body, iron rod and spade has been made from the appellant.
Without expressing any opinion on the merits of the case and considering the submissions advanced, we find that no good ground is made out for enlarging the appellants on bail.
The bail application of the appellant Kallu Yadav, involved in S.T. No. 152 of 2004 (State of U.P. vs. Kallu Yadav and others) arising out of Case Crime No.153 of 2004 under Section 364, 302, 201 IPC, PS- Puramufti, District Kaushambi is, accordingly, rejected.
The hearing of the appeal is expedited.
Office is directed to prepare the paper book within six months.
List thereafter the appeal before the appropriate Bench for final hearing.
