By application 38Ga filed by the petitioner in Civil Appeal No. 1/2017, he prayed before the Appellate Court that before deciding the appeal, the CD filed by him, in support of his contention that he is in possession of the suit property, be examined. The application has been rejected by the Appellate Court by impugned order dated 9.2.2018.
In the opinion of the Court, the order impugned is purely an interlocutory one, and does not call for scrutiny at this stage, in exercise of supervisory power under Article 227 of the Constitution of India. The petition stands dismissed with liberty to the petitioner to challenge the impugned order along with the final order/judgment passed in appeal, in case, occasion for challenging the judgment of the Appellate Court arises.
