Heard learned counsel for the petitioner, learned Standing Counsel for respondent no. 1 and Sri A.K. Yadav, learned counsel for respondent no. 2.
Learned counsel for the petitioner submitted that petitioner is working as Assistant Teacher at Primary School Padum Pichhaura Hujurpur, District Bahraich and her husband is suffering from serious disease, therefore, as provided under Rule 8(2) of Uttar Pradesh Basic Shiksha Education (Transfer) (Posting) Rule, 2008, she submitted an application dated 29.7.2019 before respondent no. 2 for inter district transfer at the place of residence of her husband at Kanpur Nagar. He further submitted that a suitable direction may be issued to respondent no. 2 to consider the application of the petitioner and transfer her at the place of residence of her husband at Kanpur Nagar.
Sri A.K. Yadav, learned counsel for the respondent no. 2 submitted that application of the petitioner dated 29.7.2019 shall be considered and decided in accordance with law at the earliest.
Considering the facts and circumstances of the case, the writ petition is disposed of with a direction to respondent no.2 to consider and decide the application of the petitioner dated 29.7.2019 strictly in accordance with law maximum within four weeks from the date of production of certified copy of this order. Petitioner is also directed to annex the photocopy of the application dated 29.7.2019 as well as annexures alongwith certified copy of this order.
It is made clear that Court has not adjudicated the case on merits and it is upon the respondent no.2 to decide the application of the petitioner after considering the Rules and Government Order occupying the field.
