The applicant-convict prisoner has preferred this application through jail on the ground of betrothel ceremony of his daughter.
It appears that without verifying the jail record the District Magistrate, Rajkot, by his order dated 6-5-2008 relying on the opinion of the DSP, Junagadh, that there is likelihood of the applicant-convict prisoner absconding if released, had rejected the application for parole leave of the applicant-convict prisoner.
The jail record of the applicant-convict prisoner reveals that he was released on parole/furlough leave on several occasions and had surrendered in time. This shows that the DSP. Junagadh , had in a mechanical manner gave adverse opinion against the applicant-convict prisoner without verifying the jail record. Consequent upon that, the District Magistrate rejected the parole leave application of the applicant-convict prisoner.
The record also shows that the applicant-convict prisoner has been recently released on furlough leave in the month of February, 2008.
In that view of the matter, this application is rejected. However, it is directed that the DSP, Junagadh, and the District Magistrate, Rajkot will take proper care while deciding leave applications of convict
-prisoners.
