JUDGMENT / ORDER

Application for bail under Section 439 Cr.P.C.
2. Petitioner is the 20th accused in Crime No.1074/2011 of Hosdurg Police Station registered for offences punishable under Sections 143, 147, 148, 283, 332 and 307 r/w Section149 I.P.C.
3. Prosecution case, in short, is that on 11-10-2011 at 7.00 p.m., the accused persons about 20 in number, formed themselves into an unlawful assembly, with deadly weapons and committed rioting. They pelted stones towards the police party and attacked the police officers. They set fire to a jeep causing a loss of Rs.1,50,000/-.
3. Heard the learned counsel for the petitioner and the learned Public Prosecutor.
4. It is seen that the petitioner is involved in a series of crimes. He is let on bail in other cases. Considering the stage of investigating and nature of allegations, I find that the bail can be granted to the petitioner with following strict conditions :
1. The petitioner shall be released on executing a bond for Rs.50,000/- (Rupees fifty thousand only) with two solvent sureties each for the like sum to the satisfaction of the Judicial First Class Magistrate Court-I, Hosdurg.
2. The sureties shall produce documents to establish their identity and solvency.
3. The petitioner shall appear before the Investigating Officer on all Wednesdays between 10.00 and 1.00 a.m until final report is filed.
4. The petitioner shall deposit Rs.10,000/- (Rupees ten thousand only) before the court below.
5. The petitioner shall surrender his passport, if any. If he does not have a passport, he shall file an affidavit stating that fact before the court below.
6. The petitioner shall not leave the limits of revenue District, Kasaragod without permission of the trial Magistrate.
7. The petitioner shall not indulge in any offence while on bail.
8. The petitioner shall not influence or intimidate the witnesses or meddle with the investigation in any manner.
9. If any of the above conditions is breached by the petitioner, the learned Magistrate is free to cancel bail without referring the matter to this Court.
