Learned counsel Mr. Nirad Buch, appearing for the petitioner, relying upon the statement made by learned A.G.P. that new seniority list has already been finalized in the year 2004, submitted that the petitioner will be required to consider the new seniority list and grievance, if any is surviving or arising after publication of the new seniority list, will have to be agitated in a fresh proceeding. Under the circumstances, the present petition is required to be disposed as infructuous, without prejudice to the rights and contentions of the petitioner. Learned A.G.P. having no objection, the petition is disposed as infructuous without entering into merits. Rule is discharged with no order as to costs.
