ORDER
When the matter is taken up for hearing, the learned counsel sought permission to withdraw the petition with a liberty to raise all the points in Trial. However, he has also made a representation that the first petitioner, who was injured in the alleged occurrence is immobilized below his hip and it is difficult for him to move.
2. In view of the above submissions and the endorsement made by the counsel for the petitioner, the petition is dismissed as withdrawn.
3. However, the presence of the first petitioner before the Trial Court is dispensed with and he is directed to appear on the hearing dates when his presence is insisted by the Trial Court, especially, at the time of framing of charges and also at the time of questioning.
4. Since the matter is pending from the year 2013, the Judicial Magistrate-I, Chengalpet, is directed to give priority to this case and dispose of the matter as expeditiously as possible. No costs. Consequently, connected miscellaneous petitions are closed.
