THE HON'BLE MR JUSTICE C.V.NAGARJUNA REDDY ORDER:
WRIT PETITION No.16130 of 2007 In this writ petition, the grievance of the petitioner is that the respondents are not taking any action to arrest the accused in FIR No.169 of 2006.
In the counter affidavit sworn to by the Sub-Inspector of Police, Gospadu Police Station on 12.09.2007, it has been stated that the investigation of the case is still pending, no arrest was made and that necessary action will be taken against the accused depending upon the evidence adduced during the course of investigation. It is assured that all possible steps are being taken by the investigating officer to complete the investigation as expeditiously as possible and to file an appropriate report before the jurisdictional Magistrate.
At the hearing, neither the learned counsel for the petitioner nor the learned Assistant Government Pleader for Home is able to state whether appropriate report has been filed by the police.
In view of expiry of more than 2 ½ years and having regard to the assurance given by the investigating officer that appropriate report will be filed as expeditiously as possible, it is reasonable to presume that such a report would have already been filed. If the final report is not filed so far, respondent No.2 is directed to file the same within a period of one month from the date of receipt of a copy of this order.
Subject to the above direction, the writ petition is disposed of.
As a sequel to disposal of the writ petition, WPMP.No.20500 of 2007 filed by the petitioner for interim relief is disposed of as infructuous.
