PRAYER: Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of certiorari to call for the records connected with the proceeding of the respondent in Proc.No.2035/E1/2010 dated 01.02.2010 and the consequential order in Lr.Rc.No.2035/E1/2010 dated 30.11.2010 and quash the same.

The petitioner has filed this writ petition to call for the records connected with the proceeding of the respondent in Proc.No.2035/E1/2010 dated 01.02.2010 and the consequential order in Lr.Rc.No.2035/E1/2010 dated 30.11.2010 and to quash the same.
2. Today, when the writ petition is taken up for hearing, the learned counsel appearing for the petitioner would submit that the prayer in the Writ Petition has become infructuous in view of the subsequent orders passed by the respondent. However, he would submit that the respondent has not paid the subsistence allowance to the petitioner during the suspension period.
3. The learned counsel appearing for the respondent submitted that the subsistence allowance has been paid to the petitioner from January 2011 to October 2011. However, if there is any dispute regarding the payment of arrears of subsistence allowance, the petitioner may directed to make representation to the concerned authorities to claim the relief.
4. In view of the submission made by the learned counsel on either side, the Writ Petition is dismissed as infructuous with liberty to the petitioner to make representation before the concerned authorities for the payment of arrears of subsistence allowance, if any, to be paid to the petitioner during the suspension period, if he is so advised. No costs.
