Heard learned counsel for the applicant, learned AGA and perused the record.
The applicant is unfortunate father of a three years old girl, who was subject to rape by opposite party no. 2. The only prayer sought by the applicant is that a board of doctors may be constitute for re-examination the daughter, who was subject to rape in the year 2018 of which the FIR was got registered as case crime no. 236 of 2018, u/s 376 of IPC and 5/6 POCSO Act.
Submission made by the learned counsel, that the C.M.O., Rampur as well as C.J.M., Rampur are passing the bugs and not considering the plight of the poor girls.
Thus it is directed that the C.M.O. Rampur would constitute a board of at least three doctors within a week from receipt of this order, who shall hold an ossification/radiological test of the victim as well as her bodily examination, as she was subject to rape. The report by the panel of doctors would be handed over within a week thereafter in a sealed cover to the concerned C.J.M.
With this observation, the present application u/s 482 Cr.P.C. stands disposed of.
