The parties were present on 29.9.2014. After interaction with all the parties we passed an interim order on the said date. The daughter of the petitioner was admitted in a hostel and is present today before us.
2. We have interacted with the girl today also. It is informed that they have given notice for registration of marriage under the Special Marriage Act before the Sub Registrar, Thuneri. Counter affidavit has been filed by the 6th respondent, a copy of which was made available for perusal before this Court by the learned counsel for the respondent. We have interacted with the parents of Ms. Incy Joseph also. According to her, she wants the love and affection of both sides. But she cannot keep away from the 6th respondent. She wants to continue her relationship. Since W.P.(Crl) No.393 of 2014 :2:
she is aged 23, it is up to her to take a decision and as she has expressed her desire to live with the 6th respondent, we permit the same.
2. Her parents submitted that they have availed a loan from the Syndicate Bank for her educational purpose. If the girl is going along with 6th respondent, then she may have to undertake the liability to discharge the said loan. She readily agreed that she will discharge the liability. We record the same.
3. We also direct the 6th respondent and the girl Ms.Incy Joseph to complete all the formalities under the Special Marriage Act.
The Writ Petition (Crl) is accordingly disposed of.
