Heard learned counsel for the petitioner and learned Standing counsel for the State-respondents.
The petition has been filed seeking the following relief-
"i) Issue a writ, order or direction in the nature of mandamus directing the respondent no.2 to decide the recall application on 09.11.2010 before the Naib Tehsildar, Tehsil Kaptanganj, Harraiya, Basti in Case No.705 of 2010 in suit Nos.705/704/706 of 2010 (Ram Tej Versus. Ram Pyare) under Section 34 of Land Revenue Act, of village Kherka Deori, Tappa huriyar, Pargana Nagar Purab, Tehsil Haraiya, District Basti, contained in (Annexure No.3) of writ petition."
It has been stated that a recall application filed against the mutation order passed in favour of the contesting respondent is pending consideration since 2010.
Perusal of the order sheet reveals that most occasions, the matter had been adjourned on account of lawyers being on strike.
The writ petition is disposed of directing respondent no.2 to consider and dispose of the restoration application expeditiously.
It is provided that in case the lawyers continue to be on strike and the petitioner does not appear in person, the directions above need not be complied with.
