JUDGMENT / ORDER

The petitioner filed this contempt petition on the strength of an interim order granted by this Court on 18 July 2013.
2. The learned counsel for the petitioner contended that even after passing interim order to maintain status quo, the respondents proceeded to lay the pipeline.
3. The plea taken by the petitioner is disputed by the first respondent in his counter affidavit. According to the first respondent, the pipeline in question was laid way back on 2 March 2010, long before passing interim order by this Court.
4. In view of the dispute now raised by the first respondent, there is no question of adjudicating the contempt petition.
5. The issue raised by the petitioner requires to be decided by this Court in W.P.No.19595 of 2013. I am therefore of the view that the writ petition itself should be heard on merits, rather than taking up the contempt petition. It is open to the petitioner to raise all the issues before the writ court. The closure of this contempt petition should not be construed as an expression of opinion with regard to the contention taken by the first respondent that the pipeline was laid on 2 March 2010.
6. The contempt petition is closed with the above observation.
