Heard Sri Ajay Vikram Yadav, learned counsel for the applicant, learned A.G.A. for the State and perused the record.
This application under Section 482 Cr.P.C. has been filed for quashing the order dated 22.06.2018 passed by Addl. Sessions Judge, Court no.4, Mainpuri in S.T. No.44 of 2014, in case crime no.74/2006 u/s 307, 504, 506 IPC, P.S. Barnahal, District Mainpuri.
Learned counsel for the applicant submits that the informant of the case has died and moreover, the injured/witness who is still alive has not been examined by the trial Court till date.
After having heard the learned counsel for the parties present and perused the impugned order as well as the material brought on record, I am of the view that the impugned order does not suffer from any irregularity, illegality or jurisdictional error, hence no interference is required by this Court. The prayer for quashing the impugned order is refused.
However, the trial Court is directed to conclude the trial preferably within a period of eight months from the date of production of certified copy of this order after recording the presence of the injured in accordance with law.
The present 482 Cr.P.C. application is, accordingly, disposed of.
