Heard learned counsel for the applicant, learned A.G.A. for the State and perused the record.
This anticipatory bail application has been filed on behalf of the applicant seeking anticipatory bail in Case No. 918 of 2017 (State of U.P. through Drug Inspector, Hathras vs. Jitendra Kumar Agarwal and others), under Sections - 18(a)(I) read with Section - 16, 17(b), 17A(f), 17B(d) and 18B and 27(b)(i), 27(c), 27(d), 28A, 22(3) of the Drugs and Cosmetics Act, 1940, Police Station - Kotwali Hathras, District Hathras.
The applicant was enjoying the interim protection and was on anticipatory bail previously in this case and is still on the same.
I have considered the facts of this case and fact of this case, which carries weight vis a vis the arguments, however the position of the applicant is that he runs a drug company and he manufactures different kinds of medicines.
Now, the interim protection is extended till 10th August, 2021. Thereafter, the applicant will surrender the very next day preferably on 11th August, 2021 and he may seek regular bail and in case the bail application is moved on 11th August, 2021, the same shall be considered expeditiously and in case the Presiding Officer of the court concerned is on leave or is not present in the court, then the case shall be heard by another competent court of the same judgeship and speaking order shall be passed the very same day by the court concerned.
With the aforesaid observation, this application stands disposed of.
Nothing has been observed on the merit of the case.
It is made clear that, if the applicant does not surrender before the court concerned, within the time prescribed by this Court, then due course of law would follow against the applicant.
