Heard learned counsel for the appellants and Sri Bhanu Prakash Singh, learned brief holder for the State and perused the impugned judgement and order.
This appeal has been preferred by appellants- Jhabbu and Tika Ram- against the judgement and order of VI Additional District & Sessions Judge, Bareilly dated 30th March, 1984 in Sessions Trial No.299 of 1981, State Vs. Jhabbu and Tika Ram and the maximum sentence awarded to them are life imprisonment for offence under Section 302/34 IPC. The rest of the sentence is lesser sentence and all the sentences have been ordered to run concurrently.
From the perusal of the report of the CJM- Bareilly dated 12.07.2018 which is on record of this appeal as Flag 'A', it transpires that both the appellants in this appeal- Jhabbu and Tika Ram have died due to natural death.
Learned State Counsel for the State has submitted that in view of report of CJM- Bareilly dated 12.07.2018, this appeal is liable to be abated.
In view of the submission made by learned State Counsel for the State and on perusal of the recitals contained in report of CJM- Bareilly, this appeal is dismissed as abated.
