Sri K.K. Mani, learned counsel has appeared for Gaon Sabha. This writ petition has been filed with the following prayer:-
"(a). Issue a writ, order or direction in the nature of mandamus commanding/directing the respondents to take action for removal of encroachment and illegal sale and purchase of the land area 518 bigha 1 bishwa 1 bishwanshi situated at village Jalalabad, Pargana Thana Bhawan, Tehsil and District Shamli of public utility land i.e. Ponds, Khalihan and passaage (rasta) etc."
From the perusal of the writ petition, it transpires that the petitioners have approached this Court raising a grievance that some encroachment has been made over the public utility land.
The petitioners have a remedy under Section 67 of U.P. Revenue Code, 2006 for approaching the authority, concerned.
In view of the above, writ petition is not maintainable.
Petitioners may approach the authority as given under the U.P. Revenue Code, 2006.
Writ petition is dismissed as not maintainable.
