This criminal revision has been filed seeking quashing of the judgment and order dated 16.1.2018 passed by the Addl. District & Sessions Judge/Fast Track Court no.1, Fatehpur in Criminal Revision No. 17 of 2016, Hanuman Prasad versus Jeevan Singh and another, whereby the aforesaid revision was allowed.
The aforesaid criminal revision has been filed against the order dated 4.12.2015 passed by the Addl. Chief Judicial Magistrate, Court No.10, Fatehpur in Complaint Case No. 240 of 2013, Hanumant Prasad versus Jeevan Singh, whereby the revisionist has been summoned to face trial under Sections 323, 504 and 506 IPC.
Heard learned counsel for the revisionist, learned AGA and perused the record.
Learned counsel for the revisionist has not been able to point out any illegality, impropriety or incorrectness much less than any abuse of the court's process which may persuade this court to interfere in the impugned order. All the facts and circumstances of the case have been gone into in great details by the revisional court and a detailed analysis has been done. The revisional court was of the view that the summoning done by the Magistrate was not under the appropriate sections and the allegations with regard to certain other sections were well made out. It was in that view of the matter, the court below passed the impugned order making observation for summoning the accused under the additional sections also. A perusal of the record makes it so clear that the allegations were apparent on the face of record and, therefore, the order passed by the court cannot be faulted with. It is not a case where any point of law is involved. It is simply a matter to see as to what offences are made out on the basis of the allegations that are there against the accused. In such circumstances, there is no ground to allow this revision.
The revision lacks merit and is dismissed.
