Heard learned counsel for the petitioners.
The petitioners are defendants in original suit no. 179 of 2017 (Satyavrat Tiwari vs. Jeet Bandhan and another).
The prayer in the present petition is to issue a direction to the Court below to expedite the proceedings of the suit. The defendants herein have filed a counter claim on 8.9.2017 alongwith an injunction application. The injunction application filed by the plaintiff is also pending.
In view thereof, without expressing any opinion as to the merits of claim of the petitioners, the present petition is being disposed of with the direction to the Court below namely the Civil Judge (Senior Division), Gorakhpur to decide the pending temporary injunction application in original suit no. 179 of 2017 (Satyavrat Tiwari vs. Jeet Bandhan and another) as also the pending application in the counter claim filed by the defendants.
Both the applications shall be decided, expeditiously, preferably, within a period of three months from the date of submission of certified copy of this order, after providing due opportunity to all concerned.
