Present petition has been filed seeking a direction upon the respondent no.3 to allot 5% developed land in respect of the land of petitioners of Khasra no.400 measuring 1.671 hectare situated at Village-Kudauli Bangar, Pargana- Dankaur, Tehsil-Sadar, District-Gautam Buddha Nagar, which was acquired by notification dated 8.9.2008 issued under Section 4 of the Land Acquisition Act (for short 'Act') and declaration dated 16.9.2009 under Section 6 of the Act.
Case of petitioners is that they were Bhoomidhar with transferable right of the land mentioned above. The said land was acquired after the necessary notification was made under Section 4 and 6 of the Act by the State Government for acquiring the same for planned industrial development for respondent no.3. The said notifications were challenged by means of various writ petitions before this Court, and in one of the leading case of Gajraj and others Vs. State of U.P. and others, this Court by judgment and order dated 21.10.2012 disposed of all the writ petitions.
According to petitioners, they moved an application on 4.2.2019 for allotment of 5% developed land, which is pending consideration before the authorities concerned.
We have heard Sri Sanjay Kumar Mishra, learned Counsel for the petitioners, learned Standing Counsel for respondent nos.1 & 2 and Sri Kaushalendra Nath Singh, learned Counsel for respondent no.3.
As no useful purpose will be served by keeping the matter pending, with the consent of the parties, we direct the respondent no.3 to look into the grievance of petitioners and decide the representation of petitioners dated 4.2.2019 in accordance with law, expeditiously, preferably within a period of three months from the date of production of certified copy of this order.
With the aforesaid observation, writ petition is disposed of.
