Learned Additional Public Prosecutor, Mr.K.L. Pandya waives service of notice of Rule on behalf of the respondents.
The present application has been preferred by the applicant-convict for temporary bail on the ground that he wants to undertake post death ceremony of his elder brother, who had expired on 19.9.2011.
The Death Certificate is produced on record. Therefore, the ground appears to be genuine. As stated by the convict, the wife of his elder brother has also expired and minor son is there.
Under the circumstances, the applicant be released on temporary bail for a period of ten days from the date of his actual release on furnishing personal bond of Rs.5,000/- and one surety of like amount with the further direction that upon expiry of the period, he shall surrender before the Jail Authority. The Application is allowed to the aforesaid extent. Rule is made absolute.
