JUDGMENT / ORDER

1. Heard, learned Advocate for the applicant and Mr.Parikh, learned A.P.P. for the opponent State.
Following aspects are considered.
The applicant is charged with offence punishable under Sections 302 read with Section 114 of the IPC and Section 135 of the Bombay Police Act.
The account of incident as given by eye-witness Savitaben reveals that the applicant while chasing the deceased alongwith his brother picked up a stone and threw it at the deceased; whereas main head injury is not attributed to him.
No antecedents are indicated.
Considering the above aspects, the application deserves to be allowed and is allowed. The applicant is ordered to be released on bail in connection with Crime Register No.I-272 of 2009 of Amraivadi Police Station, on his executing a bond of Rs.10,000/- (Rupees Ten Thousand only) with one surety of the like amount to the satisfaction of the lower Court and subject to such conditions which the lower Court may deem fit to impose.
Rule is made absolute.
Direct Service is permitted.
