Counsel for the petitioner submitted that learned Magistrate on a private complaint after initially deciding the whole inquiry under Section 202 of Criminal Procedure Code through Police, later on, an application by the complainant by an order dated 8.7.2009 sent the complaint for investigation under Section 156(3) of Criminal Procedure Code. He stated that so far as no charge-sheet has been filed.

Considering the submission made, issue Notice returnable on 13th October, 2010. In the meantime, order dated 8.7.2009 shall stand stayed.
