JUDGMENT / ORDER

(Per : HONOURABLE MR.JUSTICE PARESH UPADHYAY)
1. By way of the present application, the applicant-convict has prayed that he be enlarged on temporary bail to attend the marriage of his brother which is scheduled on 24.04.2012.
2. Pursuant to the earlier order passed by this Court, learned APP Shri Pandya has submitted, based on the report of the Superintendent of Police, Kheda that the ground mentioned in the application is genuine.
3. From the jail remarks, we find that whenever the applicant was enlarged on temporary bail or was furlough, he has surrendered to the jail authority in time.
4. Considering the totally of the facts, it is directed that the applicant-convict shall be enlarged on temporary bail for a period of ten days from the date of his actual release on personal bond of Rs.5,000/- and one surety of like amount. It is further directed that the applicant-convict shall surrender on expiry of period granted by this Court.
5. The application allowed to the aforesaid extent. Rule made absolute accordingly.
