Heard learned counsel for the applicant, learned A.G.A. for the State and learned counsel for the opposite party no. 2.
The present criminal revision has been preferred against the order dated 1.5.2018 passed by learned Addl. Session Judge/F.T.C. No. 2, Hapur in Session Trial No. 382 of 2017 (State Vs. Prince @ Naved and Others), under Sections- 147, 148, 149, 472, 307, 504 I.P.C., Police Station- Hapur Nagar, District- Hapur.
Learned counsel for the opposite party no. 2 points out that while this application remained pending, non-bailable warrant was issued against the applicant. The applicant then proceeded in application u/s 482 Cr.P.C. No. 22526 of 2018 in which proceeding, the fact of the present case, being pending in the court was disclosed. In such circumstances, limited indulgence was granted to the applicant to approach the learned court below and a breathing time of 45 days was also allowed.
Such indulgence having been granted, at present, no interference is warranted in the present application which is directed against the summoning the applicant under Section 319 Cr.P.C. as two orders i.e., one that has been already been passed by this Court on the other application u/s 482 Cr.P.C filed by the applicant and the present order, may not run in different directions.
The present criminal revision is accordingly dismissed.
